#1 ... He would be on the stand under oath saying where he got the wood.
#2 ... It's HIS wood, and therefore HE is responsible for it. Regardless if it was stolen or not.
Your argument is similar to saying that the kid who drowned in your pool when you weren't home is not your responsibility. While that's true ... you'd still probably get sued and be found negligent because you didn't do "enough" to prevent him gaining access to your pool. Or the salesman who came into your yard and was bitten by your dog. Yep ... you're responsible because you didn't do enough to prevent his access.
If you are really serious about your remark above, you'd be well advised to study a few past cases similar to that and see what the results really were.![]()

Not arguing, just curious...the owner of the woodpile would be guilty of what?? Storing his powder in his wood? Is that illegal? I'm in total agreement that doing something that could cause bodily harm is not justified, but curious what law would be broken in that case.
In the case of the gas can if someone stole a can filled with sugar, it locked up their car engine and they got rear-ended by a semi, would the owner of the gas can be liable??

Seriously?
OK ... I'll bite ... Obviously, you wouldn't "store powder" in a woodpile. His only reason would be to do bodily harm to another person. Such an act is usually considered to be "reckless endangerment" and carries a pretty tough punishment in most cases. It doesn't take a rocket scientist to figure out what happened. Any detective or investigator worth a darn would figure this out in 2 minutes. And I highly doubt that a jury hearing your premeditated murder trial would have much sympathy for you when you said you killed the guy for stealing fire wood.![]()

Not Guilty, I have doubts that the true owner of the wood knew the powder was in there. Also I need evidence that the powder was in the wood. How do I know the theif was not playing with the black powder and causeed his own accident. If I were the true owner of the wood I wouldn't ever admit to placing the powder in ther. Theif got what he deserved and probably less. Should chop his hands off. I hate theives.![]()
