Agreed....if someone's getting beaten to where they could be killed then no question, but in the case of just losing a fight, that's a completely different story.

I think the answer to your question is relatively simple. I don't think the answer to mine is so easily assertained, made more difficult by the various state statutes.
I guess for yours, you need to define "picking"

Here are two scenarios.
Fisherman 1 is sitting in his usual spot fishing. Fishermant 2 comes working his way down the same bank. He goes around F1 and continues fishing. They meet up back at the ramp. F1 approaches F2 with the usual arguement about fishing too close etc. F2 says he has every right fish where he wants. F1 gets all in his grill, and pushes F2. They start fighting and F2 has F1 down and is whaling away on him, so F1 shoots F2 and kills him. Is this self defense?
Same scenario as the first, except after F1 gets in F2's grill, F2 pushes him away, then they start fighting, with the same results. Same answer or different answer?
