Man, I feel your pain. Nothing more frustrating than gear that makes you look like the problem. Especially when it's brand new and refuses to act up in front of the mechanic.
Honestly, your theory about a silent fix might not be far off — could’ve been something like a loose choke linkage or even a flooded carb the tech spotted and quietly corrected. If that’s the case, maybe give it one more honest shot before dumping it on Marketplace.
But yeah, I totally get the urge to slap a Yamaha EFI on there and call it a day. Sometimes peace of mind is worth more than brand loyalty.

That's a good point. I have a lot of Stihl stuff and there is a cold start procedure. Works every time if you follow it. Won't start at all if you don't. But the difference here is the Stihl owners manual tells you what the procedure is. Doesn't sound like the Merc owners manual has anything like that.

Since it's a 9.9 I'd presume it has a motor located kill switch, not on the boat.
The seller will not sell you a defective product, he wouldn't want a bad report on BBC where millions of members read it. It could cost him sales.
I'd suggest you take a fuel sample from your source or tank in a glass jar and look at it, and take your boat with you to the dealer. He should want to please you.
What cha want for it?
This is what I was going to ask you. Why? Because a friend of mine that brought his Tracker to a dealer to have the motor get going, spent $1300 and when he hooked up his tank and hose, it wouldn't run.
Here's why, the plastic sleeve that is in the connector on the motor end of the fuel hose.

I've had a lot of problems with hoses and bulbs and connectors lately. Even brand new out of the box. If they aren't using the same fuel supply, you might have a air leak

9.9 carb merc’s have been known for bad starting for 30 years, that’s why all the walleye guys ran kicker Yamahas, back in the day. The old fix was drill out the brass plug on the carburetor and adjust the air fuel ratio.
Get rid of it and buy a EFI Merc or Zuki…life’s to short to struggle with a crap little engine.
so how cheap are you selling known good motor with warranty?

No Sir, you aren't stupid. We have all had various issues with different motors as well as many other things in life. I had a pressure washer motor that wouldn't start and determined the oil level was a tiny bit low, same with my little 4 stroke Honda 2.3 HP boat motor--wouldn't start and same problem, a couple of ounces low with oil so go figure.
