SO I dropped the lower unit yesterday and i found that there was no slinger washer on top of the pump housing could this not cause the same issue?

No. Not all engines use a slinger washer.

Sorry its been awhile. I pulled the power head and replaced the gaskets inspected for cracks there where none. Reinstalled everything added a slinger washer above the pump ( exploded view showed one ) put it in the water and the issue is gone. So I'm guessing a bad gasket or the slinger washer took care of the issue..

    Thanks for everyone's help
