Here's another article if you care to read. If not, I've highlighted the pertinent part of the article. You don't have to like it, and guys like me can ignore it, but it doesn't change the facts.

"May consider" does not mean it's a law. You need to learn how to interpret what you read.

I'll just sit back and eat some unflashed
There's lots of decaffeinated brands that are just as tasty as the real thing.

    Hi Mike.

Did you even read the article you posted? It’s actually an opinion piece based on speculation, none of which is actual law.. ..and to think you brought up reading comprehension previously.

    “The EPA’s continuing skepticism…”

    “EPA’s interpretation”

    “Purportedly”

“In the future, the EPA may consider…”

“It is possible it could be conceived otherwise,…”

You’ve also made the incorrect assumption that any performance modifications will change emissions, (irrelevant as that may be) include ECU reprogramming, or in fact, create 75 more horsepower.

    Still not illegal.

Do research. Plenty of aftermarket EPA compliant tunes for various car engines that add tons of torque and hp but don’t run afoul of the law.
In the future they may go after your tune, that's what the article is warning about, not that in the future the EPA will create a new regulation.

I've had plenty of tunes, he's the fine print from my last one:

Go read each of my replies in this thread, I've been pretty clear that modifications MAY be illegal. Especially if you are increasing HP, you are increasing the likelihood of changing emissions that the engine was originally certified at. I'm not talking about a K&N filter.

Sure there may be tunes out there that went through the EPA or CARB certification process and are legal. But they still had to prove those mods either did not increase emissions or were otherwise compliant.

OK last link since no one seems convinced by my diatribes. Read closely about tampering, changes to fuel and timing, and why they don't go after people (reasonable bias). I'll gladly enjoy my TUNED outboard as I get in some fishing tomorrow! Peace out fellas!

    We do.

Just to throw this in here.
My Ford is Tuned with a FACTORY TUNER FROM FORD. This retains the factory warranty. If tuners were illegal, they would not even come close to touching the tuning world with a 10 foot poll.

Wish I could flash my 2 stroke, cause I would.

I like this part... "As a matter of enforcement discretion, the EPA’s longstanding practice has been not to take enforcement action against vehicle owners for removing or defeating the emission controls of their EPA-certified motor vehicles, so long as they can show the vehicles are used solely for competition events and no longer driven on public roads".

I'm in competition with myself to get to the next honey hole...
