    Pistol brace clarification

    Serious question. if I combined my pistol with a Cush It rod end, does this make it an SBR? I have seen pistols with cushioned ends, maybe to put to your cheek, not sure what they are for. IMG_3996.jpg
    Lord, please keep your arm over my shoulder and your hand over my mouth.

    I don’t think it would but why not just SBR it? It was free for months. I know some think it’ll be overturned which I hope it is. I SBR’d mine because I have a Trust and it had to have been in the Trust prior to the ruling so I paid the $200 so I could do what I wanted to with it.

    I am by no means an expert here. My thoughts are that it would not fly. My reasoning is that I thought the whole thing with the pistol brace was it gave you something to shoulder. Such as the end you have added adds extra surface area to the rear making it shoulderable. Yeah I know we will say its just foam its not a butt plate or stock but the comeback will be why do you need extra padding on the very rear unless you WILL SHOULDER it.

    As much as I dont like it I would guess it wont fly. Or I at least wouldnt be taking it to the range.

    Some folks do not want to be subjected to an unconstitutional tax/law/registry.

    Just get yourself a padded shoulder pad. There are a bunch out there. Then no need for a device on the “pistol”.

    Understand but it’s kinda useless without a brace or stock. No different than any of the other NFA items to me. They offered a free stamp for the pistol braces for months. SBR’ing it only takes a couple of weeks, maybe 3, from my experience.

    This should help some. "The rule’s amended definition of “rifle” clarifies that the term “designed, redesigned, made or remade, and intended to be fired from the shoulder” includes a weapon that is equipped with an accessory, component, or other rearward attachment (e.g., a “stabilizing brace”) that provides surface area that allows the weapon to be fired from the shoulder, provided other factors, as listed in the definition, indicate the weapon is designed and intended to be fired from the shoulder."

    If you want the complete text;

    The best answer probably came from C130. Get the stamp for an SBR and you are good to go.

    Ruling came down yesterday, the ATF's new rule has been blocked by the SCOTUS.
