High school trouble. HELP!!!!!!

What happens if a teacher leaves a classroom full of students and criminal mischief happens? Do u think that the teacher should be liable? What if a student had a seizure, or a fight broke out, or something got vandalized? and the school is pinning it all on the students. Is this fair? PLEASE help with suggestions.

Agreed. Pretty sad if it took a teacher to keep high school students in line. Something happens while the teacher's out of the room it has absolutely nothing to do with the teacher.

A teacher is a teacher. A teacher should not be responsible for the actions of students when not in the room. Parents still need to be the people teaching their kids right from wrong. No way, no how should a teacher be legally responsible for the criminal actions of a student. That is just a cop-out for parents.

The teacher could be held liable, but let's not let all the blame lie there. Hopefully this isn't a rant defending a kid that doesn't know how to behave. What if this same kid gets criminal on the way home. Teacher's fault?

When I was in high school, teacher left the room, we learned pretty quick it was a good idea to not cause a lot of issues.

If kids of that age can't behave for a few minutes, then I don't see where a teacher is liable for that.

I am a high school teacher and you don't leave your class unattended. You will be held liable. I am at a school now where I have been for 13 years in a small town and do it sometimes (restroom etc). The school before, no chance would I leave those kids unattended.

WSe need a more concise description of the issue. However, I would say NO the teacher is not responsible.

I guess it depends on how long they were gone and what happened. The whole seizure scenario would concern me if the teacher knew of a pre-existing condition, and left that student unattended.

But we are talking high school students, not early elementary students, there has to be some level of accountability that falls on the students to know how to behave.

It would greatly depend on what happened, and what were the circumstances that surround it for me to make any judgement or assumptions on who was at fault.

That being said, as a high school teacher - I would never leave my classroom unattended.

I do know that on a legal level the only way a teacher can personally be held accountable in a suit is in matters of abuse - this includes actions such as neglect.

There is plenty of case law concerning this situation. Although there can be many mitigating circumstances, the teacher will often be held liable if they are not in the classroom if something happens.

Not sure why you are asking, but a teacher should never be held responsible for the bad behavior of students! The teaching of decent behavior is the job of the parents!!!!!!

I am a high school teacher also, and the teacher IS responsible for the students in the room. You don't leave a room unattended.

Oh come on we all know teachers are all libaral, union, terriost. Get real kids have one person to worry about and that is themself and if the decision to do right can't be made without a teacher there 24-7 I would say this has to do with upbring not education

And that is sooo wrong!!! Back in the RESPONSIBLE day, the teacher was NOT the one responsible . We, as a society, have screwed up when we make the teachers answerable to the parents' job!!!

I don't even see how it would be the teachers responsibility for a seizure. She's not a physician or EMT. Who would be responsible if the kid seized in the hall between classes, in the bathroom, in the parking lot before school? Are we gonna assign a personal health supervisor to each child? Teacher job is to be in the class, being out of class is not part of her job description. But you can't hang her for having to leave the classroom
