    Any landlords out there

    How do you go about evicting someone these days. It appears the good old days of going in and throwing their stuff outside doesnt happen any more. Can anyone give me some guidance here. Thanks

    When I had to do it, you have to go to the court house and file, and they may tell you to stay away from the location for 30-60 days. They did me, and during that time, the house was trashed.

    It took almost 3 months from the time I filed till they told her to get out.

    I think it depends a lot on the state.
    I am told that it is a pretty fast and easy process in Indiana, not so in Illinois.
    Local Sheriff will probably give you guidance on where to start.

    you need to follow the law to the "T" also - with the 'tenant rights' nowadays, they can sue you back for just about anything..........it's a very touchy subject.

    My wife is the manager for (3) low to medium income housing developments........she's got alot of section 8 tenants too.........she'd got an attorney that files all her stuff - but she's still got to watch how she does things, what she says, etc.........

    Would hate to see you get jammed up - just watch yourself.

    Send the tennant an eviction notice effective within 30 days. He/She may be naive to the system and just leave without incident. If not you'll have to go through the courts as said.

    Once you give them the alotted time if they dont move a good friend tried this. She lives in Ct and her rental place is in Florida. She snuck down there. She set up a fumigation of the rental unit. The squatter was dumb enough to leave the place so the exterminator could get in. They told them to be out for 8 hours. When they were gone they emptied the place and changed the locks. Then they and some friends stood gaurd at the place so the squatter couldnt get back in.

    its very state specific as mastercaster pointed out but almost all county courthouses (where you file the paperwork at) have an outline of the procedure...........if you don't follow it to the "t" the judge will always give extra days.............I have done a couple hundred evictions in the last 10 years and only twice actually hired an attorney to help so you should be good on your own unless you have an extra special tenant I had one take me for 3 full months before I got the writ...........usually takes 20-25 days if you got it down

    again be very careful about how you handle the actual "chucking the stuff" part cause a misstep there and it starts a whole other PITA

    Forget anything these guys tell you unless they are from your STATE......It can cost about 3 grand to evict someone up here if it drags all the way out

    The way it works here
    Pay for a Constable to deliver eviction notice...Get date with court house if they are not out by that date..The judge will give them another date..If not out by then you have the police respond and then you have to pay a bonded mover and put all items in the apartment into a bonded storage unit for up to 2 years

    And god forbid if its winter time

    and if you your really pissed and want to be a dick (which I am some of the time) issue a 1099c at the end of the year for cancellation/ forgiveness of debt to the tenant for the balance of thier lease and past due amount+ all fees and expenses........hope they report that "extra income" (could be 2-10K) and pay the taxes on the extra income hope they don't get audited for not being truthful, as that would suck for some a$$hat who trashed my place and skipped out

    WOW after the writ is issued in florida its put everything on the curb and after 24 hours you can trash it.............

    In Texas you can actually enter a rental and seize property as collateral after rent is late not that brave but its a whole different game out here

    Take it from me, contact your local JP if there is one and they should be able to provide the legal guidelines for eviction. Failure to properly adhere to, could prove very costly both monetarily and legally. If property is removed from the residence and placed outside and is damaged as a result of the weather, or is stolen you can be be held liable.

    I love Texas law on a side note......I can't believe the law is actaully on the side of the landlord out here...............Fl not so much

    My brother owns a few. Years ago he had a guy about 25 served with an eviction notice, the guy told my brother he wasn't moving---and he wasn't paying rent (he was served for lack of payment, ) Sheriff told my brother "Sorry, the law protects scumbags like this" A friend of mine paid a visit to this young guy a few days after he was served, must have changed his mind cause he was out in two days. As soon as he was loaded up and leaving my brother went into house, he had the bathtub running and the kitchen sink had already started to over flow. Minimal damage because we caught it in time.

    I won't ever own rentals.

    that is where insurace is important but yes rentals SUCK and the tenants never stop finding ways to cost you money...........commercial is just as bad, don't believe me try it if you think a "normal renter" is bad try dealing with a dentist/ doctor, accountant or the worse yet lawyer as a tenant need an icon for gun in mouth

    . They did everything legal they could from 1300 miles away. The bottom line was the tenant was removed. The bad news was the next tenant did the same thing and trashed her place.

    Eddie, In Wisconsin you can hand deliver the tenant a "Notice of Eviction". By Wisconsin law they have 28 days to vacate. On the 29th day you can go to the sheriff's dept in Crandon and they will come and supervise the tenant move. Or atleast that's what happens in Kewaunee Cty....... Good luck
