did they specify only continental us shipping? I thought it was a legally binding contract, but I guess if something sold for grossly less than it was worse, a seller could just take the negative feedback? I mean they arent going to come force him to ship it will they? As easy as it is to make a new account, which im sure happens a lot.

Normally if the seller refunds the money, they will drop you a note as to why. (defective, out of stock, etc...) Send them a message and ask what gives.
check to see if he was selling locally it should say on his posting thats another way a seller can back out of an auction
