    Jeremy, Need Clarification please.

    On the boat slips at a Marina. Each slip has a sign on Each side.
    Reads:
    "No fishing within 50ft of this dock"
    I've looked in the AGFC Regulations and cannot find anything about this, SO, I felt obliged to follow the rules at hand by staying at least 100ft away from any slip in a Marina while fishing.
    Yep, I got chewed out again.

    We were fishing, boat had a slip on every side (I was surrounded by slips). But, I was more than 100ft away from any of them.

    Legal or Not?

    Its a COE reg, is it not? But, it has to be enforced, so unless the AGFC or Sheriffs Dept wants to come out to give anglers tickets, it really don't matter the way I see it.

    The signs say "50ft of THIS dock". (I mean, why would a marina waste money on all those "50ft/THIS particular dock" signs when "600ft/Any slip on the lake" signs cost the same?)

    But, tournament director said 100ft, so, that's why we stayed at least 100ft away. We just assumed he was increasing the distance of those signs, just to be safe.

    Still, I don't know what the LEGAL distance is as the law is written?

    (and, I gotta get me one of them Marina slip renter badges!!!)

    Only thing I know of that is enforced is 50ft from any commercial marina, and that's during bigger tournys....I'll fish any dock, slip, etc, that I feel like it....and smack your dock every now and then with my jig too....

    I'm more accurate than that.
    I can smack a dock every time with a jig.

    I miss the dock quite often....but somehow, I manage to center up the posts over and over....keep saying to myself, bet I couldn't that again...then BAM!...

    You give me a dock with 40ft of open water on either side 2" wide steel pole. I'll hit the pole every time!

    You give me a cove with 40ft of open water on either side of a 12" diameter stump. The only way I'll hit that stump is with the trolling motor.

    All I know is if you see a red sign (which should be on commercial docks only) then you should not fish with in 50 ft of that dock. That is a COE rule but wildlife officers can write ticket for not following signage. I know of a few tickets wrote on Bull for that but i don't think it was by a AGFC WO.

    THIS DOES NOT APPLY TO PRIVATE DOCKS!!!!! So don't let them run you off if you are fishing a private dock!!

    Clairday's boat is so slow, Most dock fisherman fish Marks boat.

    Here's the deal with the docks guys-

    It it is a lake or waterbody run by the little rock distric of the corps of engineers NO ONE(not marina owners/slip renters) are allowed to fish within 50' of the dock. NO ONE. You see someone fishing from the dock I would encourage you to call the lake manager on it. Here's why-

    In the early 2000's the federation, AGFC, Missour parks, BASS, USACE LR and marina owners in little rock district hashed out a deal that would allow us to fish docks but not gas areas/commerical areas if I remember correctly. Everyone agreed.

    The next year the marina owners basically hosed us.

    Without discussing it with any of the previous parties USACE LR was called to Bull Shoals and Norfork to come "See all the damage" caused by bass fisherman fishing the docks. They were shown torn seats, scratched cowlings, line hanging from docks and other things.

    USACE LR led by Col Jackson(who is honestly a good guy) then went to the Division office in Dallas and tried to secretly have this rule changed to read that all docks leased by USACE LR could have ALL fishing banned within 50' of any dock. NO one was told of this other than the marina owners that essentially ignored their agreement. USACE tried to secretly do this but when a gentleman in Norfork? got a ticket in 2007? it all came to light.

    Public discussions on the topic were held which became the usual song and dance from USACE. On behalf of the Federation and ABA I met with Col Jackson to try to change this and to discuss why this had happened. That's how I know the story above.

    Col Jacksons opinion was that since the two parties could not get along that he would make this rule and prevent ANYONE from using this water for recreational activities.

    This halo only applies to USACE LR lakes- not ouachita, degray, greeson and others.

    It does not apply to private docks in the USACE LR district. Only marina's that have a lease from the USACE LR district office.

    Private docks are fair game.

    It isnt trespassing to access water they put their dock on. If they want to call the Sherriff they can but unless the marina has lease with USACE they have no other option than to call the county sherriff who isnt coming.

    I also highly doubt AGFC enforcement will touch this.

    So, basically, it's like the "marina" signs read: "50ft from this dock"

    It's not 50' from the marina "area".
    It's not 50' from the "outermost" dock.
    It's not 50' from the farthest dock on each end.

    I was setting in the middle of a marina area, surrounded by their docks.
    I was More than 100 feet away from any of them.
    So, when the guy pulled up, shut off his motor, and asked "Can you read?" and I pointed to one of those red signs and said "I think so, but, just to be sure, maybe you could read that outloud for me."
    He never read it, Never looked, BUT...He proceeded to tell us his interpretation of it though.
    Anyway, I assume I was legal, and all was okay?

    Danny, your logic sounds correct to me. (I can't believe I just said that.) Sounds to me like some a$$hat just wanted to pound his chest. I think you were in the right.

    Just making sure.
    It's easy for anybody to justify themselves no matter right or wrong.
    And, I've now been confronted twice, in cold weather, when very few are on the lake. Each time by the only other boat in sight. On lakes I have pretty much never fished before, and still have rarely fished.
    I could go out on Dardanelle every day for a year and probably never be confronted about anything.
    Just wondering....What the heck??
