This is about to get pushed down our throats here in Alabama. Meeting is this Saturday!

STATE OF ALABAMA REGULATION 2008¬-MP¬-1
(Marine Police)
MONTGOMERY COUNTY

By authority vested in me as Commissioner of Conservation and Natural Resources of the State of Alabama as provided for by §33-5-62, Code of Alabama 1975, I do hereby establish, proclaim and promulgate the following regulation, which has the force and effect of law:


Section 1. Rule 220¬-6¬-.60, entitled "Speed Restrictions” is hereby adopted, to read as follows:


“220¬-6¬-.60 Speed Restrictions


(a) Except as provided in paragraph (b), no person shall operate any “vessel” (as defined in §33-5-3, Code of Alabama 1975) or tow a person or persons on water skis, an aquaplane, a surfboard, or any similar device on the “waters of this state” (as defined in §33-5-3, Code of Alabama 1975) at a speed greater than 60 miles per hour during daylight hours or 40 miles per hour at night or during inclement weather, or greater than idle speed within 50 feet of any vessel which is moored, anchored, or adrift, or greater than idle speed within 75 feet of any wharf, dock, pier, piling, person in the water, or shoreline adjacent to a full-time or part-time residence, public park, public beach, public swimming area, marina, restaurant, or other public use area.


(b) In the “waters of this state” where the distance from shoreline to shoreline or bank to bank is less than or equal to 200 feet, no person shall operate any “vessel” at a speed greater than 40 miles per hour.


( c) This regulation shall not be interpreted to prohibit any person from initiating or terminating water skiing from any wharf, dock, or pier nor shall it be interpreted to prohibit the immediate return of a tow vessel to a downed water skier. The above restrictions shall not apply to ocean-going ships or to tugboats or other powered vessels which are assisting ocean-going ships during transit or during docking or undocking maneuvers, or to the operation of vessels on the Intracoastal Waterway.


(d) Nothing in this regulation shall be construed to exempt any person from compliance with all other safety laws and regulations or other requirements of law for the operation of vessels.


(e) Any person violating any of the provisions of this regulation shall be punished as provided by §33-5-62, Code of Alabama 1975.”


Section 2. This regulation shall become effective on the 36th day after adoption and filing with the Legislative Reference Service.

I have no problem with that......I like to go fast as well as the next guy,...but I also like to go home at the end of the day.

That's fine I can't quite hit that speed anyway...lol

Thought I would pass this along from a director of the Alabama Bass Federation Nation

Just dropping a line to keep everyone informed of the latest developments. I attended the Alabama Conservation Advisory Board meeting in the State Capital Building today to make sure the advisory board was made aware of our (ABFN) position on this issue. I registered to speak along with hundreds of people that were there for a proposal to make deer hunting with dogs illegal. After listening to testimony of several people on other conservation issues I was given the chance to speak.
I addressed the Board as a representative of the Alabama B.A.S.S. Federation Nation as well as the President of the Auburn Bassmasters. I touched on several points to enforce our belief but as my time ran out I answered several questions form several of the Advisory Board Members. At this time I was informed by a gentleman that the decision had been made before this meeting to not pursue this measure. There had obviously been enough response from all parties involved that all of the Board members assured me this would not be an issue.
I assured them that I felt our position on this matter still needed to be enforced in their minds. I feel we have won the battle for now but there are people on the Advisory Board that I believe really want a law of some type concerning this issue to be passed. We will have to keep our eyes and ears open to protect our rights on our public lakes. To make sure we maintain the same rights to public waters even though we might not own property on said water.. Thanks to all of you that sent letters and made contacts

its all money, if they enforce a law like that, the state loses, noone will ever have a big bass event on a lake with speed limits, thats why the motors get bigger and bigger,you want to pass a good law, make it illegal for a 12 year old kid to run a sea doo 60 mph across the lake, you should be atleast 16 to operate any motor vehicle on the water

I don't know...I've seen some forty year olds that shouldn't be operating a Sea Doo either! Maybe they should just outlaw Sea Doos.

I vote for that too! might as well include ski boats in that bill as well.

You got that right unclemark!!! Gville was almost short a skidoo, if I had been on plane let alone full throttle I would have got the sob.

We were outside the single island where gville tuns west and heads towards the dam. anyway out of that whole big area in the bend he decides to cut across my bow.Unbelieveable.

It's a good thing mine only runs 43mph strung out!
