I asked same question. I did ask if I tied a rope to it was it still within the regulations and was told yes. Kidding aside parts of James near the bluff that the current is fast and if I ever had to throw it to someone in need it would reach them. Rope tied to off would allow me chance to throw it more than once.
Last thing I want in my memory was person drowning right in front of me. Have launched at Dutch Gap and see kids on launching pier at ramp.

Law seems kinda screwey and hard to comply with.
Law makes no distinction over running or fishing,, But exactly where are you gonna put it, that isnt in a compartment, not in a protective cover, or under other gear that wont have it fly away at 70mph ?

Most people sit on them when running.

Keep it in storage while running and pull it out when you stop. With a dual console you can secure it under the passenger console with velcro or a small cargo net the car mfg provide for groceries. The LEO's and USCG folks that conduct boat checks are normally pretty reasonable.
