My 2020 trailer came standard with surge brakes. In regards to legality of brake requirements, in IL, trailers rated for 3000# or more require brakes. Not sure if other states require the same.
This is the trailer depth I load at too. My 2017 178 loaded at the same depth. Never had any issues.
